Trade barrier summary

Barriers in the music industry include:
1) Section 31D of the Indian Copyright Act provides an option for statutory licensing for communication of published literary works, musical works and sound recordings to the public, by way of broadcast. Presently, there is uncertainty over the scope of this provision.

2) Copyright term: The term of copyright of 60 years for sound recordings, beginning from the next year of it being published, is more than the international standards-TRIPS and Berne, but shorter than the term of protection provided in many other countries-including UK.

3) Enforcement: Infringement and copyright piracy, which may be significant in scale and in some cases are also concentrated in particular regions, seriously undermine music industry revenues.
